Terms of Service

Agreement

These Terms of Service ("Terms") govern your use of FavoritesHQ (the "Service"), operated by Nimble Labs ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use FavoritesHQ. By using the Service you represent that you meet this requirement and have the legal capacity to enter into these Terms.

Your account

  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You may delete your account at any time from inside the app (Settings → Delete Account). Deletion removes your favorites, gift profiles, partner connections, daily-quiz history, and account record.
  • We may suspend or terminate accounts that violate these Terms or otherwise abuse the Service.

Your content

You retain ownership of the favorites, gift profiles, quiz answers, and other content you create on FavoritesHQ ("Your Content"). By submitting Your Content you grant us a worldwide, non-exclusive, royalty-free license to host, display, and process it for the purpose of operating the Service.

You are responsible for Your Content. Do not submit content that is illegal, infringes others' rights, contains malware, or harasses other users.

Sharing and partner features

  • Gift profile share links are unguessable URLs but are not protected by login. Anyone you share a link with can pass it on. Delete a profile to revoke access.
  • The daily quiz reveals your answers to your partner once both parties submit. Only do this with people you trust.
  • You can disconnect a partner connection at any time. Disconnecting ends future daily quiz rounds with that partner; previous rounds remain in your history until you delete your account.

Acceptable use

You agree not to:

  • Impersonate another person or misrepresent your relationship to them.
  • Scrape, mass-collect, or otherwise abuse the Service or its API.
  • Bypass rate limits, spam invitations, or send unsolicited communications.
  • Reverse-engineer the Service except as permitted by law.
  • Submit content that is illegal, hateful, defamatory, sexually explicit, or that depicts minors in a sexual context.

Intellectual property

The FavoritesHQ name, logo, design, and software are owned by Nimble Labs and protected by copyright and trademark law. We grant you a personal, non-transferable, revocable license to use the Service. We do not grant any other rights.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, free of errors, or that any data you submit will not be lost. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

Limitation of liability

To the maximum extent permitted by law, Nimble Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service.

Changes

We may update these Terms as the product evolves. Material changes will be communicated by email and shown in-app. Continued use after a change constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Alabama, USA, without regard to its conflict of laws rules.
